What Constitutes BUI in Pennsylvania?

Pennsylvania law makes it illegal to operate or be in actual physical control of a watercraft while under the influence of alcohol or a controlled substance. The law applies to all watercraft, including motorboats, PWCs, sailboats, canoes, and kayaks.

There are two ways to be charged with BUI. The first is a per se violation: operating with a BAC of 0.08% or higher. The second is an impairment violation: operating while rendered incapable of safe operation due to alcohol or drugs, regardless of BAC level.

“Actual physical control” is broader than simply driving. If you are sitting in the operator’s seat with the ability to start the engine, you can be considered in control of the vessel even if it is not moving.

All BUI offenses involving injury, death, or property damage to others carry enhanced penalties, including a minimum 48-hour jail sentence and fines starting at $500 for a first offense.

Minors on Board Enhancement

If a minor (person under 18) is present on the watercraft at the time of the BUI offense, the charge is automatically upgraded to a first-degree misdemeanor, regardless of BAC level. This carries a maximum penalty of up to 5 years in prison.

Waterways conservation officers and other law enforcement agencies conduct BUI enforcement on Pennsylvania waters, particularly during holiday weekends and peak boating periods. Officers may stop vessels for safety inspections and can administer field sobriety tests and request chemical testing (breath or blood) if they suspect impairment.
