Take an Official State-Approved Boater Safety Course
Quick Answer
Pennsylvania prohibits operating a watercraft with a blood alcohol concentration (BAC) of 0.08% or higher. BUI is a criminal offense — a first offense is a third-degree misdemeanor carrying up to 6 months in jail and $300 in fines. Repeat and high-BAC offenses carry significantly harsher penalties including mandatory jail time and fines up to $10,000.
Learn about Pennsylvania boating laws and license requirements.
Pennsylvania law makes it illegal to operate or be in actual physical control of a watercraft while under the influence of alcohol or a controlled substance. The law applies to all watercraft, including motorboats, PWCs, sailboats, canoes, and kayaks.
There are two ways to be charged with BUI. The first is a per se violation: operating with a BAC of 0.08% or higher. The second is an impairment violation: operating while rendered incapable of safe operation due to alcohol or drugs, regardless of BAC level.
“Actual physical control” is broader than simply driving. If you are sitting in the operator’s seat with the ability to start the engine, you can be considered in control of the vessel even if it is not moving.
Pennsylvania classifies BUI into five categories based on BAC level and substance:
| Category | BAC / Condition | Description |
| Alcohol Impairment | Below 0.08% but impaired | Incapable of safe operation due to alcohol |
| Per Se BUI | 0.08% to 0.099% | Standard BUI |
| High Rate | 0.10% to 0.159% | Elevated BAC |
| Highest Rate | 0.16% or higher | Significantly elevated BAC |
| Drug / Controlled Substance | Any amount | Any controlled substance in system |
Offense | Category | Jail Time | Fine |
First | Alcohol Impairment | Up to 6 months probation | $300 |
First | Per Se (0.08-0.099%) | Up to 6 months probation | $300 |
First | High Rate (0.10-0.159%) | 48 hours to 6 months | $500 – $5,000 |
First | Highest Rate / Drug | 72 hours to 6 months | $1,000 – $5,000 |
Second | Alcohol Impairment | 5 days to 6 months | $300 – $2,500 |
Second | Per Se | 5 days to 6 months | $300 – $2,500 |
Second | High Rate | 30 days to 6 months | $750 – $5,000 |
Second | Highest Rate / Drug | 90 days to 5 years | $1,500 – $10,000 |
All BUI offenses involving injury, death, or property damage to others carry enhanced penalties, including a minimum 48-hour jail sentence and fines starting at $500 for a first offense.
If a minor (person under 18) is present on the watercraft at the time of the BUI offense, the charge is automatically upgraded to a first-degree misdemeanor, regardless of BAC level. This carries a maximum penalty of up to 5 years in prison.
Waterways conservation officers and other law enforcement agencies conduct BUI enforcement on Pennsylvania waters, particularly during holiday weekends and peak boating periods. Officers may stop vessels for safety inspections and can administer field sobriety tests and request chemical testing (breath or blood) if they suspect impairment.
Refusing a chemical test in Pennsylvania can result in enhanced penalties similar to the highest-rate BAC category.
While BUI and DUI share similar BAC thresholds and penalty structures, there are differences. A BUI does not result in the suspension of your vehicle driver’s license (it affects boating privileges only). However, a BUI conviction is a criminal conviction and can affect background checks, employment, and other areas of life just like a DUI.
