What the Law Says

Under Alabama Code Section 33-5-66, any person required to hold a Boater Safety Certification who operates a motorized vessel without one is guilty of a boating violation. This is classified as a misdemeanor under Alabama law.

Fines and Penalties

A person convicted of operating without the required certification faces:

  • A fine of not less than $10 and not more than $100 for each violation.
  • Court costs in addition to the fine.
  • A misdemeanor on your record.

While the base fines may seem modest, court costs can significantly increase the total amount owed. Multiple violations on the same outing could each be treated separately.

Certification Suspension and Revocation

Beyond fines, ALEA has the authority to suspend or revoke your Boater Safety Certification for serious violations. Your certification can be suspended or revoked if you are found:

  • Operating a vessel while under the influence of alcohol or drugs.
  • Operating a vessel in a reckless or negligent manner.
  • Repeatedly violating Alabama boating laws.

A revoked certification means you must retake the safety course and reapply through ALEA before legally operating a motorized vessel again.

Enforcement: What Happens on the Water

ALEA Marine Patrol officers actively patrol Alabama waterways and have the authority to stop and inspect any vessel. During a stop, officers may ask to see your Boater Safety Certification or vessel operator’s license. You are required by law to carry your card on board and have it available for inspection.

If you cannot produce your certification during a stop, the officer may issue a citation on the spot. Saying you have a license but forgot it at home does not eliminate the violation—the law requires you to have it in your possession while operating.

What About Exemptions?

If you qualify for a statutory exemption (such as the age exemption for those born before April 28, 1954, or the rental vessel exemption), you are not in violation even without a standard Boater Safety Certification. However, it is strongly recommended that you carry documentation of your exempt status.
